IMPORTANT NOTICE:

This is a legally binding agreement between you and Atlanta School of Tantra Yoga, LLC. By accessing or using our website, app, or any related Services, you agree to these Terms, along with our Privacy Policy and Cookie Policy—whether or not you have read them in full. If you do not agree, you must immediately discontinue use of our Services.

These Terms of Service (“Terms”) govern your use of www.ecstaticu.com, the EcstaticU mobile app, and related services (collectively, the “Services”) provided by Atlanta School of Tantra Yoga, LLC (d/b/a EcstaticU) (“Company,” “we,” “our,” or “us”).

1. Who May Use Our Services

You must be at least 18 years old to access our Services. By using our Services, you represent that you are at least 18 and have the legal authority to enter into this agreement.

2. User Accounts & Conduct

To access certain features, you may be required to register an account. You agree to provide accurate information and maintain the confidentiality of your login credentials.

You agree not to:

Violate any applicable laws or regulations
Transmit any unauthorized or unsolicited promotions (spam)
Use the Services for unlawful, abusive, or harmful purposes
Upload malicious software or attempt to disrupt the platform
Impersonate any person or entity
Post content that is unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable

Community Standards:

By participating in the EcstaticU app or any online community features, you agree to uphold respectful communication and shared spiritual integrity. Harassment, hate speech, spam, or the sharing of others’ personal information is not tolerated. We may remove or restrict access to users who violate these standards.

We reserve the right to suspend or terminate accounts for any behavior that violates these Terms or harms our community.

We also reserve the right to deny or discontinue Services at our sole discretion, including but not limited to situations where user behavior violates our community standards, terms of conduct, or creates an unsafe or disruptive environment for others. We reserve the right to determine what constitutes such violations at our sole discretion.

Account Settings & Privacy Controls:

You may manage the public visibility of your profile, posts, and notification preferences within your EcstaticU account settings. Platform communication settings (e.g., in-app and email notifications) are distinct from our marketing communications, which are managed through our CRM. Unsubscribing from promotional emails will not affect essential platform messages. See full details in our Privacy Policy

Communication Preferences

By registering a user account through our Services, you agree to receive essential email communications related to your membership, including account notifications, service updates, and relevant operational messages.

By registering, you also consent to receive content-based and promotional emails that are integral to your membership experience, including updates on new offerings and community events. These communications are intended to support your spiritual journey and engagement with our community.

You can opt out of non-essential emails at any time without affecting your access to your membership or purchased content.

Your preferences regarding marketing communications are respected and can be updated through the email management and unsubscribe links provided in any email or by contacting our support team.

3. Payments & Billing

Some Services require payment. All purchases are governed by the applicable purchase terms presented during checkout. Refund policies, if applicable, are provided on the relevant sales or registration pages. We do not store your payment data; payments are processed via third-party providers (e.g., Stripe, ThriveCart, Square).

3.1 Website-Based Subscriptions

For recurring subscriptions purchased via our website using third-party platforms above, users can manage their subscriptions from their user account or by contacting our support team. Email reminders are sent prior to each renewal, and users are responsible for managing their recurring charges.

You are responsible for ensuring your payment information is up to date and for monitoring renewal dates. No refunds will be issued if you fail to cancel your subscription prior to the renewal date. Should we agree to a refund, any associated transaction or processing fees will be deducted.

3.2 App-Based Subscriptions (Apple/Google)

For purchases made via the EcstaticU mobile app, payments are processed through either Apple’s App Store or Google Play. In such cases, the billing terms, refund policies, and account management are governed by Apple or Google directly, and not by Atlanta School of Tantra Yoga, LLC. Users must follow the procedures of the respective platform to manage subscriptions or request refunds. We cannot modify or cancel these subscriptions on your behalf.

3.3 One-to-One & In-Person Services

In addition to online offerings, we provide virtual and in-person services including, but not limited to, spiritual counseling, coaching, astrology consultations, and wellness sessions. These services may have separate scheduling, payment, refund, or cancellation policies presented at the time of booking.

4. Intellectual Property

“EcstaticU™,” “Ecstatic Union™,” and “Ecstatic Relationship™” are trademarks or service marks of Atlanta School of Tantra Yoga, LLC. All content, designs, logos, names, educational materials, videos, courses, and platform features are the intellectual property of Atlanta School of Tantra Yoga, LLC or its licensors. You may not copy, reproduce, modify, distribute, or republish any content without express written consent.

User-generated content you submit (e.g., comments, posts, images) remains yours, but you grant us a non-exclusive, royalty-free license to display and distribute it within the platform.

Your data is collected and used according to our Privacy Policy and Cookie Policy, which are incorporated into these Terms.

6. Platform Availability

We strive to keep the Services running smoothly, but availability may be interrupted due to maintenance, upgrades, or unforeseen issues. We are not liable for downtime or access disruptions.

While we aim to make our Services accessible to as many users as possible, we cannot guarantee compatibility with all devices, screen readers, or regional access. We are committed to ensuring our Services are accessible to the widest possible audience, regardless of technology or ability. We reserve the right to suspend, restrict, or terminate your access to the Services at any time and without prior notice if you violate these Terms, create risk or legal exposure for us or others, or for any reason at our sole discretion.

In the event of account suspension or termination due to a violation of these Terms or community standards, no refund or compensation will be issued. All such determinations are made at our sole discretion.

We may link to or embed third-party tools (e.g., YouTube, TidyCal, Google Analytics). We are not responsible for their content, policies, or services.

8. Disclaimers

Our Services are intended for spiritual education and personal development, based on our proprietary Ecstatic Union™ system. They are designed to support your healing, self-awareness, and growth, but are not a substitute for professional medical, psychological, or legal advice. Our Services are not intended to diagnose, treat, or cure any medical or mental health condition, nor are they a replacement for licensed mental health counseling, psychotherapy, or medical care.

This includes all of our offerings—such as Ecstatic Union™ Coaching, Ecstatic Relationship™ Coaching, Vedic Astrology readings, and community engagement—which are educational and spiritual in nature. If you are experiencing a medical or psychological emergency, please seek immediate care from a licensed provider.

You understand and agree that your use of our Services is entirely at your own risk, and that we make no guarantees regarding individual outcomes. Any decisions or actions you take based on the information we provide are solely your responsibility.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, profits, or goodwill, arising from your use of the Services.

10. Indemnification

Legacy Brand/Domain. EcstaticU is the current brand for our Platform. References to “Atlanta School of Tantra Yoga” or www.atlantaschooloftantrayoga.com may appear in historical materials and emails during our transition; those references relate to this same legal entity and Platform.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles.

12a. Dispute Resolution & Binding Arbitration

Informal Resolution:

We encourage good-faith efforts to resolve disputes informally. Before pursuing legal action, both parties agree to make reasonable efforts to resolve any dispute through informal communication.

Binding Arbitration:

If the matter cannot be resolved within 30 days of written notice, it shall be submitted to binding arbitration as the exclusive means of resolution, except as provided below.

Arbitration Rules: Arbitration will be conducted in accordance with the commercial arbitration rules of the American Arbitration Association (AAA). It shall take place in DeKalb County, Georgia or virtually, before a single arbitrator.
Scope: This clause applies to all disputes, including those related to interpretation, performance, or breach of these Terms or your use of our Services.
Class Action Waiver: You and Atlanta School of Tantra Yoga, LLC agree to waive any right to participate in a class action, class arbitration, or other representative action.
Finality: The decision of the arbitrator will be final and binding. Any court of competent jurisdiction may enter judgment on the award.
Exceptions: Either party may:
- Bring an individual claim in small claims court
- Seek injunctive relief in court to prevent immediate harm
- Seek relief for unauthorized use or infringement of intellectual property

EcstaticU platform users may receive transactional emails related to account activity (e.g., platform notifications, new comments, group invitations). EcstaticU system emails are platform-generated and are not governed by CRM email subscription preferences. These emails are essential to your use of the platform.

Marketing and promotional emails (e.g., newsletters, offers, coaching invitations, new content announcements) are managed separately through our CRM. By creating an account and agreeing to our Privacy Policy and Terms of Service, you consent to receive these educational and promotional communications as part of your membership experience.

You may opt out of marketing emails at any time by clicking the unsubscribe link in any email or by updating your preferences. Unsubscribing from marketing emails does not affect access to your account, platform services, or essential communications. If you choose to reduce or stop receiving emails from us, we recommend maintaining permission for essential communications related to your membership level to ensure uninterrupted access to services.

If you previously unsubscribed from our emails, registering again on the app or website does not automatically resubscribe you. Marketing communications will only resume if you actively opt back in through a form, settings page, or confirmation email.

Platform emails and marketing emails are managed separately. You may:
